Terms of Service

1. The Service

GenGigsAI is a marketplace connecting people who want generative-AI work done ("buyers") with people who produce it ("creators"). Features may open in controlled stages, and the availability of accounts, listings, matching, and checkout is shown in the relevant part of the Service.

2. Eligibility and accounts

You must be at least 18 years old and able to enter a binding agreement to create or use an account. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for activity under your account.

3. Creator content & portfolios

Creators are responsible for the work, samples, and claims they publish, and must have the rights to everything they upload. You retain ownership of content you post, and grant GenGigsAI a licence to display it on the Service.

4. AI output & licensing

Deliverables may be produced using third-party AI tools. Buyers and creators are responsible for complying with those tools' terms. A listing's personal, commercial, or exclusive label describes the creator's contractual grant of rights they control; it does not guarantee that an AI-generated element is copyrightable, registrable, non-infringing, or free of third-party restrictions. Buyers should obtain professional advice for high-risk uses.

5. Payments

Checkout is available only when an eligible listing displays an active order action. Prices are shown in Canadian dollars. The buyer pays the creator's connected Stripe account using a Stripe direct charge, and GenGigsAI receives a disclosed 12% application fee. Stripe processing fees are charged to the creator under the creator's Stripe terms. The creator is the payment merchant shown on the Stripe transaction and manages their Stripe payout schedule.

This arrangement is not escrow. Buyer approval confirms delivery in GenGigsAI; it does not capture, release, transfer, or otherwise move payment funds.

Any public price, fee allocation, promotion, delivery time, revisions, licence, and these Terms must be available for review and correction before checkout. Sample content is not a live offer.

6. Cancellations, revisions, refunds & disputes

A buyer may self-cancel and request a refund within one hour after confirmed payment if the creator has not delivered. A full refund also returns GenGigsAI's application fee. After that window, or after delivery, the buyer may use the revision allowance or open a marketplace dispute. Opening a marketplace dispute pauses the delivery workflow while GenGigsAI reviews the available order record; it does not freeze or hold Stripe funds.

The creator is responsible through their connected Stripe account for payment refunds, cardholder disputes, dispute fees, and chargebacks. Stripe manages connected-account risk and negative balances according to the creator's Stripe agreement and the platform's Connect configuration. No marketplace-dispute outcome is guaranteed until review is complete.

7. Acceptable use

• No illegal, infringing, deceptive, or harmful content or activity.
• No impersonation, fraud, or misrepresentation of capabilities.
• No attempts to disrupt, scrape at scale, or compromise the Service.

8. Demo content

Any sample or preview content is labelled and is not an orderable offer. Public creator profiles, reviews, listings, and order history must be tied to the corresponding verified records.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee the quality, legality, or outcome of any creator's work.

10. Limitation of liability

To the maximum extent permitted by law, GenGigsAI is not liable for any indirect, incidental, or consequential damages, or for disputes between buyers and creators.

11. Communications

Transactional replies about an account, brief, hire request, order, delivery, refund, or dispute are part of providing the Service. Marketing messages require a lawful consent basis and include a way to unsubscribe. Withdrawing marketing consent does not prevent necessary transactional or legal notices.

12. Termination

We may suspend or terminate accounts that violate these Terms.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

14. Changes

We may update these Terms; the date above reflects the latest version. Continued use means you accept the updated Terms.
